Returns
/ Cancellations Policy
Wholesaletrains.com/Wholesaleplanes.com accepts exchanges only (no returns) on merchandise from select manufacturers
within 10 days from delivery. However, Wholesaletrains.com/Wholesaleplanes.com reserves the right to authorize
any product exchanges. If any product is accepted for exchange, an RMA number will be issued and a credit will
be issued toward FUTURE PURCHASES ONLY. Original shipping charges are
not refunded on returned items and additionally items for wich we pay the shipping will be only refunded less our original shipping costs. Customers are responsible for all shipping
charges back to wholesaletrains.com on returned items, and wholesaletrains.com
reserves the right to determine who will pay the shipping charges on
the replacement or exchange item(s) going back.
Exchanges must be within
10 days from invoice date, replacement at Wholesaletrains.com/Wholesaleplanes.com's
sole discretion. Please be aware that specific manufacturers have more
restrictive return policies. All non-defective merchandise exchanges are
subject to a 15% re-handling fee wich will be charged against the exchange . Other restrictions may apply.
Returned merchandise
must be in unused condition and in its original packaging. Item packaging
must be free from marks or rips. In addition any bar codes and labels
must be in thier original condition. The mounting of engines and accessories,
running fuel through engines, cutting or pushing out the balsa sheets
in kits, and other similar actions constitutes used merchandise. Radios
must be returned in original condition with un-mounted servos and switch
harness. Due to the collectible and limited run nature of train locomotives
and cars they must not have been operated or removed from thier factory
packaging.
Hazardous materials
Such as alcohol based-paints, solvents, resins, paint removers and batteries cannot be shipped via priority or rush delivery; nor can they be shipped outside of the United States.
Items which have been dropped or mishandled can not be accepted for return or exchange.
If an item shows any evidence of exterior damage the item will not be accepted back for any
reason. It will be our determination and our determination alone to decide if any item has suffered
from being dropped, mishandled or abused. Dropped or damaged items will be returned
to you at your expense or disposed of by us within 30 days.
Merchandise that
Can Not be Returned:
Merchandise on clearance or scratch and dent items will never be refunded
for any reason.
Electrical Transformers/Controllers/Speed Controls and/or Power Supplies for any reason.
Gasoline or Nitro Engines for any reason.
Gasoline or Nitro
Engine Equipped Vehicles for any reason.
Liquids and Oils
for any reason.
Batteries for any reason.
Train Track, Locomotives or Rolling Stock for
any reason.
Model Trains are not toys, They are limited run adult collectibles. The box and packaging are as important
to the value as are the contents. Therefore breaking the plastic seal on a Model Train Locomotive, Model Train Set or Train Car Destroys the items collectible value and therefore can not
be accepted for an exchange for any reason. The only exception to this would be an HO train set.
When packing your
order for return, please be sure all the original packing material
and instruction papers and/or manuals are included. We will be unable
to process your return if parts are missing, or if items are not packed
properly to avoid damage to products and their boxes and/or packages.
ARF kits are specially packaged to insure safe shipping of all contents.
In order to receive credit for a returned ARF, the contents must be returned
in the original plastic covers and arranged in a manner that will not
damage the contents or packaging. In addition all decorative packaging
must be presentable. Do not use non-transparent tape to re-seal decorative
boxes.
Returns sent COD
will not be accepted.
Defective
Merchandise
If you receive defective merchandise, please contact us for return
instructions. In most cases, we will accept returns and make adjustments;
however,
some manufacturers prefer handling defects directly. Defects found
after the product is in use fall under manufacturer's warranty. A
customer
service representative will be happy to help you determine which procedure
is appropriate for you.
Exchanges
If you are requesting another item in exchange for returned
merchandise, and if that item is a different price, please indicate how
you wish to pay or be credited for the difference. (MasterCard, Visa,
etc.)
Order Cancellation
If we receive a cancellation request after your order has been accepted
into our order processing system and we are able to physically accommodate
your request, we will charge you additional paperwork processing fees
of 7% (seven percent) or $5 minimum, which ever is more.
Orders will not not be cancelled via E-mail correspondence.
Cancellations
will not be processed within 72 hours prior to the scheduled shipment day.
If approved a cancellation verification number will be issued to all cancellations. Cancellations are not
valid without the cancellation verification number. A seperate cancellation number must be obtained
for each cancelled order and your processing fee invoices will be mailed to you.
Refusing a Shipment
If we receive a shipment back that has been refused you will be charged shipping in both directions (to and from you) as well as a processing fees of 15% (fifteen percent) or $5 minimum, which ever is more. No credit will be issued except against an exchange for different or other merchandise.
Advance Reservation/Pre-Orders
Advance Reservation Items are Ordered for you in Advance of the Release Date. Sometimes this may be at a special discount or sometimes it is necessary to reserve an item that may only be produced in short supply and / or sold out before it is produced. These Pre-Ordered / Advance Reservation Orders Are Solely Based On Our Company Having Trust and Faith that You will Pay for the Item When it Becomes Available. We do not charge you until the item ships. However To Cancel or Refuse to pay for your items when they become available is a violation of that trust and no further orders can be accepted without pre-payment. This is especially true if you order short supply items that could have been made available to other hobbiests but were held for you under false reservation. Please do not order merchandise you dont intend to pay for.
Damaged Merchandise
If a package has been damaged in shipping and it is apparent when the
package arrives at your door, please REFUSE the delivery. If you have
already accepted a package, and then discover that it has been damaged,
call us immediately at 607-795-5038. Be sure to save all paperwork and
packing material with the damaged goods. The carrier may wish to inspect
it before processing the claim. Please do not return damaged-in-shipment
merchandise yourself. The additional packaging will jeopardize your claim
and keep you from receiving credit for the return.
Backorder Merchandise
In the event that some or all of the inventory required to fulfill the order is
out of stock a backorder will automatically be generated for the items not shipped on the order. Web site stock status is only a guide to likely availability as no items are guaranteed to be available at all times and all merchandise on hand is subject to prior sale. Backorders are held open until the item is shipped from the manufacturer unless the item is sold out or discontinued. If an order can be completed or if items needed for an order are in stock in another warehouse we hold the order until the items are gathered together in one place to create the most complete shipment possible. If you add items to an order that are known to be on backorder as is stated on the web site, these items will be treated as additional shipments for that order and actual shipping charges will apply to each additional shipment as they are arrive to us from the manufacturer.
New Customers:
For your protection, we can only ship to your credit card billing address. After 90 days, you will be able to ship packages to an alternate location. We apologize for any inconvenience.
Return Privileges
- You must contact
Wholesaletrains.com/Wholesaleplanes.com Customer representative
by telephoning 607 795 5038. Customer service is available 10:00am to
6:00pm EST Monday through Friday to obtain a Return Merchandise Authorization
(RMA) before shipping product back to Wholesaletrains.com/Wholesaleplanes.com.
This will expedite and help ensure the proper action or credit upon
processing.
- In order to
expedite a return, please have the following information on hand
when requesting an RMA number: Customer number, invoice number, serial
number, reason for return, action you are requesting (replacement/store
credit) and whether the box has been opened or is manufacturer sealed.
- You must return
all products 100% complete including all original manufacturer boxes
with the UPC code and packing materials, all manuals, blank warranty
cards, accessories and any other documentation included with the original
shipment. RMA acceptance is contingent upon, among other things, the
products being 100% complete.
- Credit Card
Charge Backs - You must return merchandise before you recieve credit.
A credit card charge back issued to us for unreturned merchandise is
theft. These will be immediately turned over to an independent loss
recovery service and the proper law authorities for prosecution.
- Personal or
business check written for merchandise - A check returned to us
for insufficient funds for merchandise is theft and will be immediately
turned over to a loss recovery service and the proper authorities for
prosecution.
- Customer is
responsible for all shipping charges to Wholesaletrains.com/Wholesaleplanes.com's
distribution center for all products being shipped for return, exchange
or replacement. Products accepted by Wholesaletrains.com/Wholesaleplanes.com
for replacement will be shipped by Wholesaletrains.com/Wholesaleplanes.com
to Customer, at Wholesaletrains.com/Wholesaleplanes.com's expense, using
the shipping method of Wholesaletrains.com/Wholesaleplanes.com's choice.
Products accepted by Wholesaletrains.com/Wholesaleplanes.com for exchange
will be shipped by Wholesaletrains.com/Wholesaleplanes.com to Customer,
at Customers expense, using the shipping method of Wholesaletrains.com/Wholesaleplanes.com's
choice.
- Customer is
responsible for all risk of loss and damage to products being shipped
for return, exchange or replacement. Please fully insure return shipment
in case of loss or damage. Please use a carrier that is able to provide
you with proof of delivery such as UPS, Federal Express or Airborne
Express. This is for your protection as well as to ensure quick action
on your return.

Lost Boxes
If you feel a box has been lost in transit, please
call with the order or invoice number and a
list of the missing
items.
A tracer will be initiated
at that time. A claim number will be issued
if the carrier does not show delivery within 10
days of
the scheduled
delivery date.
Credit will be
issued for the missing merchandise when we
obtain the claim number from the carrier.
Missing Parts
Should you receive merchandise that is missing a part, please contact
us. We will ensure that you are sent the part from our stock as appropriate.
In accordance with a manufacturer’s request, we may direct the information
or your call directly to the manufacturer.
Export Sales
If this transaction involves an export under the Export Administration
Regulations, the commodities, technology and/or software sold or distributed
under these terms and conditions of sale exported from the United States
by Wholesaletrains.com/Wholesaleplanes.com were exported in accordance
with the Export Administration Regulations. Diversion, use, export or
re-export contrary to United States law is prohibited. The commodities,
technology and/or software sold or distributed under these terms and conditions
of sale may not be exported or re-exported to Cuba, Iran, Iraq, Libya,
Sudan, North Korea or Syria or to entities and persons that are ineligible
under United States law to receive United States commodities, technology
and/or software. In addition, manufacturers' warranties for exported products
may vary or may be null and void for products exported outside the United
States. In addition all taxes, user fees and Tarrif's apply to each item.
These fees if incurred by Wholesaletrains.com/Wholesaleplanes.com will
be adjusted to your account as required.
Export Orders will be shipped to you as we receive the products from
the manufacturer. (Because of space limitations we will not hold or
stage orders at our facility until complete for longer than 10 days to
accumulate products not yet available.)
Warranties
Customer understands
that Wholesaletrains.com/Wholesaleplanes.com is not the manufacturer of
the products purchased by Customer hereunder and the only warranties offered
are those of the manufacturer, not Wholesaletrains.com/Wholesaleplanes.com.
In purchasing the products, Customer is relying on the manufacturer's
specifications only and is not relying on any statements, specifications
in brochures, photographs or other illustrations representing the products
that may be provided by Wholesaletrains.com/Wholesaleplanes.com. In connection
with services, neither affiliates of Wholesaletrains.com/Wholesaleplanes.com
nor third party service providers are agents of Wholesaletrains.com/Wholesaleplanes.com.
Wholesaletrains.com/Wholesaleplanes.com has no obligation or liability
arising from any services performed by or any warranty, if any, made by,
such service providers. WHOLESALETRAINS.COM/WHOLESALEPLANES.COM
AND ITS AFFILIATES HEREBY EXPRESSLY DISCLAIM ALL WARRANTIES EITHER EXPRESS

ANY.
Limitation of Liability

LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL,
INDIRECT OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY
OF SUCH DAMAGES,
OR FOR ANY CLAIM BY ANY THIRD PARTY. NEITHER WHOLESALETRAINS.COM

BY THIRD PARTIES. CUSTOMER AGREES THAT FOR ANY LIABILITY RELATED
TO THE PURCHASE OF PRODUCTS OR SERVICES PROVIDED DIRECTLY BY WHOLESALETRAINS.COM
OR ITS AFFILIATES, NEITHER WHOLESALETRAINS.COM NOR ITS AFFILIATES
ARE
LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE DOLLAR
AMOUNT PAID BY CUSTOMER FOR THE PRODUCT(S) OR SERVICE(S) GIVING
RISE TO THE
CLAIM.
Wholesaletrains.com/Wholesaleplanes.com will not be responsible for any delays
in delivery which result from any circumstances beyond its control, including
without limitation, product unavailability, carrier delays, delays due
to fire, severe weather conditions, failure of power, labor problems,
acts of war, terrorism, general insurrection, acts of God or acts of
any government or agency.
Orders; Payment Terms; Interest; Taxes
Orders
are not binding upon Wholesaletrains.com/Wholesaleplanes.com until accepted by Wholesaletrains.com/Wholesaleplanes.com.
Terms of payment are within Wholesaletrains.com/Wholesaleplanes.com's
sole discretion. Invoices
are due and payable within the time period specified on the invoice,
measured from the date of invoice. Wholesaletrains.com/Wholesaleplanes.com may invoice
parts of an order separately. Customer agrees to pay interest on
all past-due
sums at the lower of one and one-half percent (1 1/2%) per month
or at the highest rate allowed by law. Customer is responsible for, and
will
indemnify and hold wholesaletrains.com harmless from, any applicable
sales, use or other taxes associated with the order. Customer must
claim any exemption from tax at the time of purchase and provide
the
necessary
supporting documentation. Any sales, use or other applicable tax
is based on the location to which the order is shipped. In the event
of
a payment
default, Customer will be responsible for
all of wholesaletrains.com’s costs of collection, including court
costs, filing fees and attorney’s
fees.
